6. All persons must agree to complete a pre-exercise questionnaire prior to being granted entry into any lifestyle fitness centre.
7. When using Lifestyle facilities all consumers must abide by the lifestyle membership and club rules and terms and conditions. Please speak to staff for more details.
8. All persons wishing to become Lifestyle Fitness members must agree and comply with the membership terms, conditions and rules located on the back of each membership form.
9. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend promotion.
10. The Promoter reserves the right to alter or cancel the promotion without further notice.

1. Information on how to enter and prizes form part of these conditions of entry.
2. Entry is open to all members of Lifestyle Fitness Erskineville who refer a friend to lifestyle fitness between 08/09/08 and 06/10/08. Should the referred friend become a lifestyle member during the promotional period, the lifestyle member who referred them will receive a further 10 entries into the draw.
3. The promotion commences 08/09/08 and closes 23:59 EST 11:59 on 06/10/08. The draw will take place on 10/10/08 at Lifestyle Fitness Australia Head Office, 588 New Canterbury Road Hurlstone Park NSW 2193. Winners will be notified by telephone and their name will be published on www.lifestylefit.com.au, and displayed within Lifestyle Marrickville and Lifestyle Carlton. Judges' decision is final and no correspondence will be entered into.
4. There will be 1 prize on offer to 1 individual winner.
1 x $1000.00 Cash prize. Total Prize Pool is valued at $1000.00.
5. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. Prize is subject to booking and availability.
6. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) attendance at the prize event.
7. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
8. In the event of unforeseen circumstances, the promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.
9. If the required information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, each entrant agrees that the Promoter may disclose entrants’ personal information to applicable State and Territory lottery departments, and that the winner's name and locality will be published as required under the relevant lottery legislation. By entering this promotion, all entrants will be deemed to have accepted these terms and conditions.
If the prizewinner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter at their discretion.
10. The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 11 October 2008 in order to distribute any prize which remains valid and unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). Publication of unclaimed prize draw winner will be in the Public Notices section of the Australian on 17 October 2008.
11. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
12. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry.
13. All entries become property of the Promoter the collection, use and disclosure of all personal information collected in connection with this promotion is governed by the Privacy Notice.

By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit (with their literary piece being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant.

Maxim Home Loans and lifestyle fitness Promotion

1. Details of the Lifestyle Fitness & Maxim Home Loans promotion, eligibility and terms form part of these Conditions.
2. Entry is open to residents of Australia. Employees of the Promoter (and their immediate families) and its agencies associated with this promotion are ineligible to enter.
3. To be eligible to enter this promotion, enabling consumers to receive a free six (6) month membership or renewal membership with lifestyle fitness australia, participants must sign up to a home loan, or refinancing agreement with Maxim Home Loans.
4. To qualify for the six (6) month Lifestyle Fitness Membership, or renewal, your Maxim Home Loan or Refinance must consist of a minimum amount of $200,000 (Maxim Loan), or a $300,000 (Maxim choice Loan).
5. The six (6) month renewal membership will be added to the term of your membership, not deducted from, your current membership agreement.
6. The Winner agrees to the use of their name, image and photograph for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photographs and in all material incorporating the photographs.

If for any reason this promotion is not capable of running as planned (whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion), the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
